Legislation to make taking Peep a Panty or commonly referred to as “upskirt” pictures or video illegal did not receive a hearing this year.

State Senator Tom Wyss felt compelled to write the bill after he saw News Channel 15′s reports about a loophole in Indiana’s voyeurism law.

In September, News Channel 15 reported a video store worker in Ashley was accused of taking pictures up a 10-year-old girl’s skirt.

His cell phone allegedly touched the girl’s leg, so police were only able to arrest him on a battery charge.

Current Indiana law only bans taking pictures of a person without his or her consent in a private place like a bathroom or dressing room.

The bill would have made taking “upskirt” pictures anywhere a crime punishable by up to a year in prison.

However, the bill did not get a hearing this session, because it could have increased costs to the state.

“Any bill which has the potential to increase costs – no matter the amount – to the state has a fiscal determined by Legislative Services agency which is like the Congressional Budget Office of Congress. Any new felony has the potential of costs for incarceration. This is the first year I have ever had “any amount” be the deciding factor. said Wyss

“I promise to bring it back again,” added Wyss.
